Correction to Form 400 (Agreement of Purchase and Sale) Regarding Resale Condos

The Commission has updated clauses 2.3 and 2.5 of Form 400: Agreement of Purchase and Sale to correct references to Form 402: Resale Condominium Schedule. When Form 402 was revised in May 2026, the numbering of several clauses changed. These amendments ensure the references in Form 400 point to the correct clauses.

Licensees who have an accepted Agreement of Purchase and Sale with an attached Resale Condominium Schedule must bring this change to your client’s attention, advise them to seek legal counsel, and follow any lawful instruction provided.

These revisions do not impact agreements for properties that are not resale condos.

The updated form has been provided to NSAR for WebForms. Until the new version is available via WebForms, licensees who require the updated version of the APS may either amend the current version of Form 400 to reflect the corrected clause references or contact the Commission’s Communications Officer, Chloe Kenney, via email at This email address is being protected from spambots.
