The Commission has received questions about how "having viewed" on the first page of the Agreement of Purchase and Sale should be defined when considering virtual showings, which have increased as a result of COVID-19.

The Commission does not have a definition of "having viewed" and it could be open to interpretation. To ensure clarity in these situations, the buyer's licensee could insert the words beside having viewed "electronically" or on "FaceTime", etc. You could also strike and initial both 6.1 and 6.2 and clearly write in clause 7: Additional Conditions addressing how the buyers viewed the property and what they want the seller to leave.

Office Closed For Licensing Exams
