Update to the Commission By-law
The Board of Directors has approved revisions to by-laws 726 and 605.
By-law 726 - General Disclosure Requirements
A new subsection (b) has been added to by-law 726 to ensure transactions that are not conducted on NSREC mandatory forms (commercial, builders) comply with the licensee’s requirement to disclose the capacity in which they are acting to all parties to a transaction.
Licensees that use the mandatory forms achieve this disclosure by using the Commission’s Agreement of Purchase and Sale.
By-law 605 - Handling of Trust Funds
Real estate deposits are to be held in trust by the brokerage specified in the Agreement of Purchase and Sale (APS). Compliance has identified instances where deposits, typically cash, have been deposited in to a licensee’s personal bank account and then e-transferred to the brokerage. This is not an acceptable practice. By-law 605 subsection (d), has been added to make it clear that licensees cannot use their own personal bank account to relay deposits to the brokerage.

Exam Update: November and December 2025 Writings for Old SLC Students and Brokers
The location for in-person exam writings is changing for November and December 2025 and will be held at the Commission office in Bedford.
This location change only impacts students who took the old Salesperson Licensing Course (students who enrolled prior to August 1, 2024) and students who took the Broker Licensing Course.
Students enrolled in the new SLC are not impacted by this change because those students write their exams online.
The remaining 2025 schedule, taking place at the Commission office, is as follows:
- Thursday, November 13: 9am - 12pm
- Thursday, November 13: 1pm - 4pm
- Thursday, December 4: 9am - 12pm
- Thursday, December 4: 1pm - 4pm

Audit Update
When the Commission introduced the new Audit Policy and Brokerage Transaction and Trust Account Policy in January 2025, it partnered with Baker Tilly to assist with trust audits. Due to necessary staffing challenges at their firm, the Commission has resumed conducting all trust audits in-house.
