July 2025 By-law Updates: Part 7—Conduct and Trade Practices and 8—Discipline
The By-law Task Force presented their reports recommending revisions to Part 7—Conduct and Trade Practices and 8—Discipline to the Board of Directors, who approved their reports and the revised By-law. The By-law with revised Parts 7 and 8 will be effective July 1, 2025.
The By-law updates include re-ordering, improved terminology, and restructuring to remove the former use of “articles” in Part 7.
Some by-laws have been updated for clarity without changing the actual by-law, whereas others have been significantly changed. Below are examples of some of the updates to Parts 7 and 8, effective July 1, 2025. This list does not cover every update being made to the By-law. Licensees are responsible for knowing and acting in accordance with the By-law. It is important for licensees to read the updated Parts 7 and 8.

Significant updates to Part 7 include:
- Terminology changes
- Broker responsibility
- Team supervision requirements
- Licensee availability
- Brokerage contracts for licensees and changing brokerages and contracts
- Disclosure of interest in listings for brokers and management/ownership
- Material latent defects
- Incentives
Significant updates to Part 8 include:
- New sub committee for complaints
- Updated hearing panel procedures
- Publication of discipline decisions

As a result of the By-law changes, Commission forms will be updated. More information on forms changes will be available at a later date.
Non-resident Deed Transfer Tax Update
The provincial government has recently announced that effective April 1, 2025, the Non-Resident Deed Transfer Tax rate will be increased from 5% to 10%. This change affects all Agreements of Purchase and Sale signed after March 31, 2025. For more information, click HERE.

Important Deadlines Reminder
March 24: Nominations to Join the Board of Directors
Licensees have until March 24, 2025 at 4 pm to nominate themselves to join the Board of Directors. Read this news bulletin for more information, the nomination form, and eligibility requirements.
If you have already completed this year's required CPE course(s), you can disregard the rest of this email.
June 15: Mandatory CPE Courses
Depending on your licence category, licensees must complete their required CPE course(s) on the NSAR Learning Platform before 11:59 pm on June 15, 2025.
All licence categories (salespeople, associate brokers, managing associate brokers and brokers) must complete Revisiting Consumer Relationships.
Associate brokers, managing associate brokers and brokers must also complete Broker Responsibilities Refresh.
